Welcome to Art by Vicky Whitlam. These Terms & Conditions explain the terms that apply when you use this website or purchase artwork, prints, cards, gift vouchers or commissioned artwork from me.

By using this website or placing an order, you agree to these Terms & Conditions.

1. About Art by Vicky Whitlam

Art by Vicky Whitlam is an independent art business based in West Yorkshire.

Throughout these Terms & Conditions, “I”, “me” and “my” refer to Art by Vicky Whitlam, and “you” refers to the person using the website or placing an order.

2. Products and artwork

I take care to ensure that photographs and descriptions of my artwork accurately represent the products available.

Because artwork is handmade and images are displayed on different screens, colours may vary slightly between the image shown on the website and the physical artwork you receive.

Original paintings are unique pieces of artwork. Once an original has been sold, it may no longer be available.

For prints, mounted artwork, cards and other products, availability may vary.

3. Prices

All prices displayed on the website are in pounds sterling (£).

I reserve the right to change prices at any time. A price change will not affect an order that has already been accepted and paid for.

Any applicable delivery charges will be shown before you complete your purchase.

4. Placing an order

When you place an order through the website, you are making an offer to purchase the selected products.

Your order is subject to availability and acceptance.

An order confirmation will normally be sent to the email address you provide.

If there is a problem with your order, such as an item being unavailable or an obvious pricing error, I will contact you as soon as reasonably possible.

5. Payment

Payment must be made using the payment methods available at checkout.

Payment is processed through the payment service provided at checkout. I do not store your complete payment-card details myself.

Your order will normally be processed once payment has been successfully received.

6. Delivery

Delivery information, estimated timescales and applicable delivery charges are explained on the Payments & Delivery page.

Delivery times are estimates and may occasionally be affected by circumstances outside my control, such as postal delays or extreme weather.

You are responsible for providing an accurate delivery address.

If an order is returned to me because an incorrect or incomplete delivery address was provided, additional delivery charges may apply before the order can be sent again.

For international orders, please contact me before ordering if you require information about delivery costs or availability.

7. Returns and refunds

Information about returning products and requesting a refund is provided in my Returns Policy.

Nothing in these Terms & Conditions is intended to remove or restrict any legal rights you have under UK consumer law.

8. Bespoke commissioned artwork

I offer bespoke commissioned artwork, including pet portraits.

Before work begins, I will discuss the requirements of the commission with you, including the subject, size, style, price and any other relevant details.

A commission will normally begin once the required payment or deposit has been received.

The agreed price and scope of the commission will be confirmed before I begin the artwork.

Because commissioned artwork is created specifically for you, it may not be possible to make changes once painting has begun. I will communicate with you where appropriate if clarification is needed.

Photographs for commissions

You are responsible for ensuring that you have permission to provide any photographs that you send to me for use in your commissioned artwork.

I will use photographs supplied for a commission to help create the artwork and communicate with you about the commission.

I will not knowingly use your photographs for promotional purposes without appropriate permission.

Commissioned artwork and likeness

A commissioned painting is an artistic interpretation of the photographs and information you provide. It is not intended to be an exact photographic reproduction.

Small differences in colour, markings, proportions or other details may occur as part of the artistic process.

9. Cancellation of commissioned artwork

Because commissioned artwork is created specifically for an individual customer, cancellation arrangements may differ from those applying to standard products.

If you need to cancel a commission, please contact me as soon as possible.

Where work has already started, the amount of any refund will depend on the circumstances and the work already undertaken, subject to your statutory consumer rights.

Nothing in these Terms & Conditions affects any cancellation rights that cannot legally be excluded.

10. Gift vouchers

Gift vouchers are subject to the terms stated at the time of purchase.

Please check the voucher for its expiry date and any specific conditions that apply.

Gift vouchers cannot be exchanged for cash unless required by law.

11. Intellectual property and copyright

All artwork, photographs, illustrations, written content, logos, designs and other original material displayed on this website belong to Art by Vicky Whitlam or are used with appropriate permission.

Copyright in my original artwork remains with me unless a separate written agreement states otherwise.

Purchasing an original painting, print or commissioned artwork does not automatically transfer copyright to the purchaser.

You may not reproduce, copy, scan, digitally reproduce, sell or commercially use my artwork without my written permission.

This includes reproducing artwork on merchandise, websites, social media, printed materials or other commercial products.

12. Commissioned artwork and copyright

When you purchase a commissioned artwork, you are purchasing the physical artwork itself.

Copyright and reproduction rights remain with the artist unless otherwise agreed in writing.

I may, with appropriate permission, photograph completed commissions or share examples of commissioned work for my portfolio, website or social media.

If you do not want your commissioned artwork to be used for promotional purposes, please let me know.

13. Website content

I make reasonable efforts to keep the information on this website accurate and up to date.

However, information, images, availability, prices and other content may occasionally contain errors or may change without notice.

I reserve the right to correct errors and update website content when necessary.

14. Website availability

I aim to keep the website available and functioning properly, but I cannot guarantee that the website will always be available or free from interruptions, technical problems or errors.

I may occasionally need to suspend access to the website for maintenance, updates or technical reasons.

15. Links to other websites

This website may contain links to third-party websites.

These links are provided for convenience or information. I am not responsible for the content, availability or privacy practices of third-party websites.

16. Personal information

Information about how I collect, use and protect your personal information is provided in my Privacy Policy.

17. Events outside my control

I will not be responsible for delays or failure to perform my obligations where this is caused by circumstances outside my reasonable control.

This may include serious postal disruption, natural disasters, extreme weather, power or internet failures, strikes, illness or other circumstances that could not reasonably have been prevented.

Where possible, I will keep you informed and take reasonable steps to minimise any disruption.

18. Limitation of liability

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

I will not be responsible for losses that are not reasonably foreseeable or for losses caused by information supplied incorrectly by a customer.

Nothing in these Terms & Conditions affects your statutory rights as a consumer.

19. Complaints

If you have a problem with an order, product or service, please contact me first so that I can try to resolve the issue.

20. Changes to these Terms & Conditions

I may update these Terms & Conditions from time to time to reflect changes to my business, website, products or legal requirements.

The Terms & Conditions that apply to an order will normally be those in effect when the order is placed.

21. Governing law

These Terms & Conditions are governed by the laws of England and Wales.

Any disputes will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory consumer rights that apply.
